1. Acceptance of the conditions
The client acknowledges having read, at the point of purchase, the individual conditions of sale stated on this screen and expressly declares accepting them without reservation.
These general conditions of sale govern the contractual relations betweenPhytoQuant and its client, the two parties accepting them without reservation. These general conditions of sale prevail over any other conditions featuring in any other document, except in the instance of prior, express and written exemption.
 
2. Products
The photographs illustrating the products do not enter into the scope of the contract. If errors are introduced in these, PhytoQuant cannot assume responsibility under any circumstances. The majority of the products offered to clients by PhytoQuant are available in our warehouse.
 
3. Order
The automatic registration systems are considered as valid proof of the nature, content and date of the order. PhytoQuant confirms acceptance of the order to the client at the email address communicated by the latter. The sale shall not be considered as concluded until after confirmation of the order, PhytoQuant reserves the right to cancel any order from a client with whom there is an ongoing dispute in relation to the payment of a previous order. The purchaser is responsible for the information provided during the order; in the event of any errors in the delivery details, the seller shall not be held responsible for the impossibility of being able to deliver the product.
 
4. Delivery
After confirming the order PhytoQuant undertakes to deliver to its transport carrier with 48 hours, all the items ordered by the purchaser. In turn, this transporter undertakes, through a contract with PhytoQuant to deliver the order to the purchaser's stated address provided by PhytoQuant .
For deliveries outside of mainland France, the client undertakes to pay for all taxes due on the import of products, customs duties, value added tax and any other tax due by virtue of the laws of the country where the order is being received. All orders passed to PhytoQuant are intended for the client's personal use, the clients or intended users of the products being prohibited from any partial or total resale of the products.PhytoQuant assumes no legal responsibility for taxes which are not paid by the client. Delivery shall be made through the Colissimo postal service in mainland France. Delays in delivery do not give the purchaser the right to claim damages and interest.
Deliveries in the EU are made by the Colissimo postal service; for deliveries outside of the EU, these are made by the international postal services.
In the event of possible defects, the purchaser benefits from the right of return, in accordance with the conditions set out in this document. Goods in transit are always at the risk and peril of the addressee. Always check your parcel on arrival. You have 24 hours to report any issues to the transport carrier in the event of any missing items or damage .
If the client wishes to select 2 delivery addresses, they must make 2 orders, with the corresponding delivery fees.
 
5. Cooling off period
The cooling off period is 7 days from the date of delivery. In the event you wish to exercise this right, PhytoQuant is obliged to reimburse the amounts paid by the client, with no added charges, with the exception of the return charges. The product must be returned intact and in its original packaging.
 
6. Price
The price is expressed in euros.
The price indicated on the product data sheets does not include transportation.
The price indicated when confirming the order is the final price, expressed including all taxes and including VAT for France and EU countries. This price includes product prices, handling fees, product packaging and preservation and transport fees.
 
7. Customs duties, local taxes and other import duties
PhytoQuant is not responsible for customs duties, local taxes and other import duties that are likely to be claimed by your Country. You are the importer and it is up to you to verify the possibility of importing the products which you intend to order with the local authorities.
 
8. Payment
The amount invoiced to the client is the price indicated on the order confirmation sent by PhytoQuant. The cost of the products is payable starting from the day on which the order becomes effective.
Payment is made by bank card displaying the acronym CB.
For online payments, CM-CIC Paiement allows you to pay through a bank server in a secure environment. The number on your bank card is therefore directed to the bank's servers and your payment is made directly to a bank through a secure environment without going through the store's server. An even more important guarantee is that your banking details are known only by our banking partner.
The order validated by the client will only be considered effective once the banking payment centres involved have given their authorisation. In the case that said centres decline payment, the order will be automatically cancelled and the client informed. PhytoQuant reserves the right to decline any order from a client with whom there is an ongoing dispute.
 
9. Disputes
This contract is subject to the laws of the Principality of Monaco. PhytoQuant cannot be held responsible for the inappropriate use of the products sold. This also applies in the event of any modification of the products resulting from the manufacturers. The responsibility of PhytoQuant shall be, in any case, limited to the total amount of the order and shall not be challenged on account of simple errors or omissions which may have remained in spite of all the precautions taken in the product presentation. You are reminded that as a general rule and subject to the evaluation of the Courts, compliance with the provisions set out in this contract in relation to the contractual guarantee assumes that the purchaser honours their financial obligations to the seller.
Claims or disputes shall always be received with the utmost goodwill, good faith always being presumed from the individual who takes pains to explain their situation.
 
10. Guarantee
The expiry dates indicated must be respected by the client.
In any case PhytoQuant cannot be held responsible for the non-respect of regulatory and legislative dispositions currently in force in the destination country; PhytoQuant's responsibility is systematically limited to the value of the product in question, the value being that on the date of sale and this without the possibility of recourse against the brand or the company that manufactures the product.
 
11. Legal information
Details about contact information gathered for the purposes of remote sales is compulsory, this information being essential for the processing and delivery of orders, establishing invoices and product traceability. Failure to provide the obligatory information shall invalidate the order. In accordance with Act 1.165 0f 23/12/1993, amended by Act 1.353 of 04/12/2008 of the Principality of Monaco, in relation to data protection, the processing of contact information in relation to clients is subject to declaration to the Commission de Contrôle des Informations Nominatives (CCIN) [Data Protection Commission of the Principality of Monaco]. The client has the right to access, amend, correct or remove any data about them, which they may exercise through PhytoQuant. Furthermore, PhytoQuant undertakes not to divulge, either free of charge or in return for payment, its clients details to a third party.
